Under the legislation of Kazakhstan, patents for inventions, utility models and industrial designs must be maintained throughout their term by paying annual official fees.

The payment periods are counted from the filing date. The fee for the next year must be paid before the end of the current year of validity. The first maintenance fee after grant is payable within 2 months from the date of publication of the grant.

• An invention patent is valid for 20 years from the filing date.
• A utility model patent is valid for 8 years from the filing date (5-year basic term + 3-year extension).
• An industrial design patent is valid for 25 years from the filing date (10-year basic term + 15-year extension).

A missed fee may still be paid within 6 months after the due date, with a 50% surcharge.
